The Illusion of checks & balances & how it is supposed to be enforced? By D. Bourne
Among the many issues (which is far from a strong enough word to describe it) with the US government and their founding documents, most of which including the constitution doesn’t support the ideas of true freedom and liberty anyway, is currently ignored or violated. Is the idea that there is a system of checks and balances. That the corporation of government has different areas or departments that actually check other areas and departments to insure they are not violating the rights of the people. Or violating the law or participating in corrupt acts. Somehow believing that this big incorporated organization actually has checks on itself. And that government checking government results in a fair and just government, with freedom and liberty for all. How is this not a huge conflict of interest? With the importance of freedom, liberty and justice of hundreds of millions of people lying in the balance. I would laugh if it wasn’t so depressing. This is the reality we live in that the majority doesn’t even give a second thought. For people that believe in government think about of all of these regulatory agencies that exist that regulate and or do checks on corporations and businesses. How would they feel if instead of the government agency appointed to check them, they just checked themselves and then told the government and the people that they had follow all of the government agency’s procedures and everything is great! Never mind the fact that also a part of this is the agency’s ability to make their own laws within their specific area of control without even being voted on by congress, not that it makes a difference at this point. But just another fun fact that congress doesn’t have the authority to give others the ability to make laws but did in a rule making bill which allows these agencies like the DEA along with a rubber stamp by the attorney general to make substances illegal. Or the EPA to ban coal and do other things that have a huge effect on not only the economy but your electric bill and your salary.
Even someone like me that doesn’t believe in government, thinks there should be private organizations separate and independent from the businesses to do checks on things like food and or drugs for example. Not that this be mandatory, but if you want people to buy your product they most likely would want a stamp of approve from a private entity that is knowledgeable in that field. But with all the fuck up’s by the FDA they would rather trust them. But in the scenario I mentioned there would be companies not only separate from the businesses they are checking but separate from the government. And there would be multiple organizations conducting things like the duties of the FDA competing for business and trust of the American people.
The better business bureau is already an example of this. They have no affiliation with government yet rate businesses and try to resolve complaints. And there are other similar agencies but the better business bureau has become the most trusted not because of government like in the case of a government agency, but because they earned their repetition from hard work gaining the trust of the American people as well as businesses, as they don’t have an automatic monopoly like other government controlled industries on the business rating industry. In fact they resolved one of my issues to my satisfaction and that of the business as well.
To make this more understandable for example you currently have the FDA which not only has a monopoly on inspection of food and drugs among other things, which first of all gives them no incentive to improve their services or worry about any accountability. Many foods have pass inspection and went out to the public that were tainted, caused sickness and even death. Probably much more then we realize or have heard about. If a private company did the job the FDA did they would have been out of business a long time ago. So instead of an FDA you would have private companies many of them competing for the business of for example drug companies. These drug inspection companies would give or not give their seal of approval. Unlike the FDA they would have an incentive to improve in every area including their level of inspection looking for innovation to insure nothing gets by them, as if they fuck up their repetition and even business is on the line. Many drug companies may even want the seal of approve of multiple inspection companies. Now these inspection companies would be accountable to the people as they would decide which ones they trust or if they wanted to buy drugs with only multiple seals of approval or take a potential risk for on drug companies with no seals of approval as the price would most likely be lower. But that would be up to the market (customers).
These inspection companies would be accountable to the people as they would be competing with other inspection companies for the business of drug companies. Of course pro government people or statists as we call them would say but who’s to stop them from taking bribes? And giving the seal of approval to companies that should not get it. As I just explained when you are in an industry that you don’t have a monopoly on you must compete with other companies. And a business so important as drugs people are putting into their bodies making mistakes could be very costly for the company and could very well put them out of business. The FDA which cannot be put out of business as they are a government agency is much more susceptible to bribes as they are also backed by the government and are essentially unaccountable. If the FDA takes bribes maybe someone gets fired but the FDA continues to exist. This is essentially the model for most government agencies, which all have a monopoly on the area and or business they regulate. Whether it is law enforcement, the department of health, or the department of justice.
The model which exists today in all government agencies and or activities is government checking government. Which is almost like a person investigating themselves. And when it comes to government as people may sometimes be held accountable, the institutions are not and continue on. And that is the think that people fail to recognize or even see the government for the corporate like institution it is. It is all about the institutionalization of government, the people themselves coming in and out are irrelevant as the institution always remains. When the brainwashed people, politicians or others supporting or in the government talk about the people are the check on the government, or the people are the government. Which is one of the most ridiculous statements I’ve heard in my life. They usually bring up something like voting. They use voting to try to convince people that they have some say in government, and that it is not just an oligarchy that is rigged and run by the elite. Of course you’re voting for a politician who is the one who has the vote in congress, or your state or county government and when it comes to ballot initiatives where there is a direct vote they are usually controlled as well by injections of millions of dollars to influence the outcome. Everything is rigged when it comes to government and has been in my opinion since the beginning when the powers that be tried to be as secretive as possible, while still trying to “follow the law” when they threw out their original government the articles of confederation for the constitution. The truth is you have no control or say in government or its laws. And even if you believe you did the majority is still deciding for you on things they have no right to.
So what power do people have when it comes to the actions of their government? The reality of it is essentially none. The government especially on a federal level but really all levels has the ability to do whatever it wants whether it be congress, the president, the Supreme Court, prosecutors, government agencies, judges, county commissions, state legislators and especially law enforcement. They have broken their own laws and their own governing document thousands if not hundreds of thousands of times. So what can you do when they violate the law? In the current system people will tell you ignorant things like VOTE THEM OUT OF OFFICE, call your congressman, start a petition or peacefully protest. And when your meaningless vote goes to the winner or loser or you get your form letter from your congressman or petition signatures it doesn’t matter. As in general it will not change anything. Maybe something small and irrelevant to the powers that be. I won’t go into it here but look at congress and how much has to happen for a law to be passed. Yet surprisingly they pass bills all the time. One’s that are part of their own agenda or the agenda of the powers that be.
There is only one way that the people would have the power to stop the government from violating their rights and passing unjust laws. Only one thing that would give them (the people) power somewhat equal to the government. As the government enforces all its laws and authority based upon one thing people with guns and government weapons. The people would have to be armed to the same extent that the government is. That is it, as if you don’t obey a law you eventually will be forced to by men with guns or kidnapped and caged. That is why they can do whatever they want breaking their own constitution and any other law. Because there is NO ONE that can stop them you can’t hold them accountable. And the institution of government is all one big corporation that again may hold some people accountable now and then but the institution never changes at least not for the better it only becomes worse and more authoritarian. Taking more freedom and control over your life. Just like some corporations throw some people under the bus to appease the people or the government. The corporation’s corrupt practices are maintained. Only the government is worse as you can’t escape them or get them out of your life or stop buying their products as you are forced by the barrel of a gun to support them via taxes. Which is the textbook definition of extortion.
For people to protest government especially law enforcement and support anti-gun legislation not only shows their ignorance it shows their hypocrisy and the result of all the brainwashing into their heads during their government indoctrination that starts basically at birth and NEVER ENDS. Which is why all dictators took the guns first. Year after year and election after election people to continue to believe that “if they just vote in the right people” and follow a piece of paper while giving others the power to rule over them everyone will live in a country of freedom and liberty. But they fail to realize what the institution of government is and it’s goal to control everything including your life and everything you do.
